FOREIGN WORKERS INSURANCE GUARANTEE (FWIG)


Foreign Workers Insurance Guarantee is a guarantee required by Immigration Department from Employers as a security deposit for the employment of foreign workers in various sectors.
Highlights of Cover

1. This insurance guarantee will serve as a guarantee to the Immigration Department to
cover repatriation expenses in the event your worker is required by the authorities to be
sent back to their country of origin during their stay in Malaysia.

2. Duration of cover set by Immigration Department is eighteen (18) months. You need to
purchase a new guarantee upon renewing your worker’s permit.
Premium

The total premium that you have to pay varies depending on Allianz’s underwriting
requirements and nationality of your worker, and also subject to minimum premium of
RM50.00 per insurance guarantee issued.

This policy is subject to RM10.00 revenue stamp on insurance guarantee.

FOREIGN WORKERS HOSPITALISATION AND SURGICAL (FWHS)


This Foreign Workers Hospitalisation and Surgical (FWHS) is specially designed in view of
increasing Hospital and Surgical charges and to reduce financial burden of the Employers of
foreign workers in the event of hospital admission of their foreign workers due to accident or illness.
FWCS/SKHPPA allows foreign workers a cashless admission into government hospitals under a Third (3rd) Class Room and Board basis but exception is given to cases which require emergency treatment at private hospitals.

Coverage Plan Details :

Daily hospital room & board: Up to 30 days; Up to RM160 per day
Intensive Care Unit (ICU): Up to 15 days
Hospital supplies and services, operating theatre, surgical fees, anaesthetist fees, ambulance fees / medical report fees
In-hospital physician visits: Up to 30 days
In-hospital specialist consultation visits: Up to 30 days
Maximum overall annual limit: RM20,000

Annual Premium per worker 120.00

Enrolment Procedures

1. The FWHS proposal forms are available at any Allianz branch offices.
2. The Employer must complete the proposal form and submit the completed proposal form
together with premium to any Allianz offices.
3. Coverage is effective upon receipt of payment of premium.
4. The Policy will be sent to the employer within twenty one (21) working days.
5. If the policy has not been received within the stipulated period, kindly contact our Allianz
branch office.
Cashless Admission
FWHS works on cashless admission basis. Admission is strictly in Government Hospitals (3rd
class). Exception is given to those cases that needs emergency treatment at any private hospital.
Upon admission, original passport of the worker needs to be produced for verification.

Definitions

Pre-Existing Illness shall be limited to disabilities which existed before the effective date of
cover and for which the Insured Person should have reasonably been aware of. An Insured
Person may be considered to have reasonable knowledge of a pre-existing condition where the
condition is one for which:
(a) the Insured Person had received or is receiving treatment;
(b) medical advice, diagnosis, care or treatment has been recommended;
(c) clear and distinct symptoms are or were evident; or
(d) its existence would have been apparent to a reasonable person in the circumstances.
Specified Illnesses shall mean the following disabilities and its related complications, occurring
within the first one hundred and twenty (120) days of Insurance of the Insured Person:
(a) Cardiovascular disease;
(b) All cancers.

Exclusions
This Scheme does not cover any hospitalization, surgery or charges caused directly or indirectly,
wholly or partly, by any one (1) of the following occurrences:
1. Pre-existing illness. However, this exclusion is waived in the event the Insured Person passes
the medical examination as confirmed by Fomema Sdn. Bhd. (FOMEMA) within thirty (30)
days from the Insured Person’s arrival to Malaysia.
2. Specified Illnesses occurring during the first one hundred and twenty (120) days of
continuous cover.
3. Plastic/Cosmetic surgery, circumcision, eye examination, glasses and refraction or
surgical correction of nearsightedness (Radial Keratotomy) and the use or acquisition of
external prosthetic appliances or devices such as artificial limbs, hearing aids, implanted
pacemakers and prescriptions thereof.
4. Dental conditions including dental treatment or oral surgery except as necessitated by
Accidental Injuries to sound natural teeth occurring wholly during the Period of Insurance.
5. Private nursing, rest cures or sanitaria care, illegal drugs, intoxication, sterilization, venereal
disease and its sequelae, AIDS (Acquired Immune Deficiency Syndrome) or ARC (AIDS
Related Complex) and HIV (Human Immunodeficiency Virus) related diseases, and any
communicable diseases requiring quarantine by law.
6. Any treatment or surgical operation for congenital abnormalities or deformities including
hereditary conditions.
7. Pregnancy, child birth (including surgical delivery), miscarriage, abortion and prenatal or
postnatal care and surgical, mechanical or chemical contraceptive methods of birth control
or treatment pertaining to infertility. Erectile dysfunction and tests or treatment related to
impotence or sterilization.
8. Hospitalisation primarily for investigatory purposes, diagnosis, X-ray examination, general
physical or medical examinations, not incidental to treatment or diagnosis of a covered
Disability or any treatment which is not medically necessary and any preventive treatments,
preventive medicines or examinations carried out by a Physician, and treatments
specifically for weight reduction or gain.
9. Suicide, attempted suicide or intentionally self-inflicted injury while sane or insane.
10. War or any act of war, declared or undeclared, criminal or terrorist activities, active duty in any armed forces, direct participation in strikes, riots and civil commotion or insurrection.
11. Ionizing radiation or contamination by radioactivity from any nuclear fuel or nuclear waste
from process of nuclear fission or from any nuclear weapons material.
12. Expenses incurred for donation of any body organ by an Insured Person and costs of
acquisition of the organ including all costs incurred by the donor during organ transplant
and its complications.
13. Investigation and treatment of sleep and snoring disorders, hormone replacement therapy
and alternative therapy such as treatment, medical service or supplies , including but
not limited to chiropractic services, acupuncture, acupressure, reflexology, bone setting,
herbalist treatment, massage or aroma therapy or other alternative treatment.
14. Care or treatment for which payment is not required or to the extent which is payable by
any other insurance or indemnity covering the Insured Person and Disabilities arising out
of duties of employment or profession that is covered under a Workman’s Compensation
Insurance Contract.
15. Psychotic, mental or nervous disorders, (including any neuroses and their physiological or
psychosomatic manifestations).
16. Costs/expenses of services of a non-medical nature, such as television, telephones, telex
services, radios or similar facilities, admission kit/pack and other ineligible non- medical
items.
17. Sickness or Injury arising from racing of any kind (except foot racing), hazardous sports
such as but not limited to skydiving, water skiing, underwater activities requiring breathing
apparatus, winter sports, professional sports and illegal activities.
18. Private flying other than as a fare-paying passenger in any commercial scheduled airlines
licensed to carry passengers over established routes.
19. Expenses incurred for sex changes.

FOREIGN WORKERS PLUS (FW-PLUS)


The Foreign Workers PLUS is designed for employers who wish to
top up personal accident coverage for their foreign workers.
Highlights of Cover

Exclusions
This policy does not cover:
1. Death or Disablement or any loss caused directly or indirectly:
a. War, invasion, act of foreign enemy, hostilities (whether war be declared or not), civil
war, rebellion, revolution, insurrection, mutiny or usurped power, military or popular
uprisings;
b. Insanity, suicide (whether sane or insane) or any attempt threat, intentional self-inflicted
injuries;
c. Any form of disease, infection, parasites;
d. Intoxication by alcohol or drugs (other than those prescribed by a qualified medical
practitioner);
e. Childbirth, miscarriage, pregnancy or any complications thereof;
f. Acquired Immune Deficiency Syndrome (AIDS) or AIDS Related Complex (ARC),
howsoever this syndrome has been acquired or may be named;
g. Provoked murder or assault.
2. Death or Disablement or any other loss sustained by Life Insured:
a. While traveling in an aircraft as a member of the crew, except only as fare-paying
passenger in an aircraft licensed for passenger service. For the purpose of this exclusion,
the Life Insured would not be covered if he/she is involved in any technical operation or
navigation whilst in the aircraft;
b. While committing or attempting to commit any unlawful act.
3. Death or Disablement or any other loss consequent upon the Life Insured engaging in
hunting, mountaineering, ice-hockey, polo-playing, steeple chasing, winter sports, rugby,
parachuting, racing of any kind other than on foot, yachting, water-ski jumping, underwater
activities involving the use of breathing apparatus, professional sports, logging activities
and using woodwork machinery driven by mechanical power.
4. Death or Disablement directly caused by or contributed by or arising from:
a. Ionization, radiation or contamination by combustion of nuclear waste from the
combustion of nuclear fuel. For the purpose of this exception, combustion shall include
any self-sustaining process of nuclear fusion;
b. Nuclear weapons material.

Replacement Foreign Workers Compensation Scheme (FWCS) to SOCSO Employment Injury Scheme


Starting 1 January 2019, Replacement Foreign Workers Compensation Scheme (FWCS) to SOCSO Employment Injury Scheme. SOCSO will take over the compensation for foreign workers according to the provision under the Employees’ Social Security Act 1969 (Act 4) covering the Employment Injury Scheme only.

OBJECTIVE
The purpose of this Circular is to inform all employers regarding the registration procedure, submission of contribution records, payment of contribution and processing of benefit claims for foreign workers with effect from 1 January 2019.

BACKGROUND
1) From April 1993, accident compensation for foreign workers came under the Workmen's Compensation Act 1952 (Act 273) which was enforced by the Department of Labour.
2) With effect from 1 January 2019, SOCSO will take over the compensation for foreign workers according to the provision under the Employees’ Social Security Act 1969 (Act 4) covering the Employment Injury Scheme only.

EFFECTIVE DATE OF IMPLEMENTATION
1) All foreign workers with valid insurance coverage under the Foreign Workers Compensation Scheme (FWCS), the Department of Labour Peninsular Malaysia (JTKSM), Sabah and Sarawak will continue to be covered under the FWCS until the expiry date in 2019.
2) The coverage of SOCSO’s Employment Injury Scheme will only take effect after the expiry of FWCS coverage.
3) If the maturity date of FWCS extends beyond 2019, the Employment Injury Scheme will automatically apply to all employers who employ foreign workers starting from 1 January 2020.
4) For new foreign workers working in Malaysia beginning on the 1 January 2019, employers must directly register them with SOCSO under the Employment Injury Scheme.

APPLICATION
1) The registration procedures, submission of contribution records, payment of contribution and processing of benefit claims for foreign workers and their dependents are similar to the existing process for Malaysian citizens and permanent resident workers under Act 4. However, the following steps should be taken as follows:
a) Foreign Workers Registration
i. Employers must register their foreign workers via ASSIST portal or complete the Foreign Worker Registration Form as in Attachment A and submit it to the nearest SOCSO office.
ii. Foreign workers are eligible to be registered with SOCSO if they possess valid working permits or equivalent documents issued by the Immigration Department of Malaysia.
iii. Employers must submit supporting documents such as a photocopy of the front page of the passport containing employee details, valid working permit or entry permit or equivalent documents
for SOCSO’s use.
 iv. All foreign workers must register to obtain the Foreign Worker Social Security No. (12-digit KSPA No.), which is compulsory for the submission of employee contribution record.
v. The 12-digit KSPA NO. must be referred to when dealing with SOCSO on all matters related to foreign workers despite any subsequent changes to the worker’s passport details, valid working
permit or equivalent document in the future.
b) Submission of Foreign Worker Contribution
i. Employers must make contribution payment based on the Second Category for the Employment Injury Scheme under Act 4, which is for the employer’s share only as in Attachment B.
ii. All foreign worker contribution payments must be made online through the ASSIST Portal or internet banking by using KSPA No.
c) Claims
i. All foreign workers benefit claims must submit a complete Foreign Worker Claim Notification Form as in Attachment C, together with supporting documents, and not using the existing Form 34.
ii. Foreign workers are not eligible to claim for education loan benefit, vocational rehabilitation, dialysis treatment that is not under the Employment Injury Scheme, and Return to Work programme.
iii. Foreign workers who die in Malaysia due to employment injury and
are buried in their country of origin, are eligible for RM6,500 in Funeral Benefit.
iv. Other than the situation above, Funeral Benefit under the Employment Injury Scheme will be RM2,000 and is paid to eligible dependents. If there are no dependents, the amount of Funeral
Benefit will be based on the amount stated in the funeral receipt, or whichever is lower.

Foreign Workers Insurance (FWIG)


Foreign Workers Insurance Guarantee (FWIG) is a guarantee required by the Immigration Department from the employer as a security deposit for the employment of foreign workers (excluding Domestic Maid) under Regulation 21 of the Immigration Regulations.

Duration of cover set by the Immigration Department is eighteen (18) months. A new FWIG is required upon renewing the foreign workers permit. The total premium payable varies depending on the nationality of the foreign worker and Chubb Insurance Malaysia Berhad (formerly known as ACE Jerneh Insurance Berhad) underwriting requirements.

This insurance serves as a guarantee to the Immigration Department to cover the repatriation expenses in the event the foreign worker is required by the authorities to be sent back to his/her country of origin during his/her course of stay in Malaysia. The circumstances could arise from:-

Foreign Workers Compensation Scheme (FWCS)


As provided under Section 26(2) of the Workmen’s Compensation Act 1952, it is mandatory for every employer to insure all their foreign workers employed by the company under the Foreign Workers Compensation Scheme (FWCS).

Chubb Insurance Malaysia Berhad (formerly known as ACE Jerneh Insurance Berhad) is one of the panel insurance companies appointed and approved by the Ministry of Human Resources to underwrite FWCS. The scheme provides foreign workers with personal accident and repatriation benefits during and outside of working hours.

All foreign workers in Malaysia are required to purchase a RM 72.00 premium per year and plus  SST 6% and RM 10 for stamp duty for Foreign Workers Compensation Scheme (FWCS) that provides RM25,000 annual coverage.

COVERAGE:
Foreign workers who are under the employment of the insured company will enjoy coverage that include

1)Accidental death: RM25,000 (working hours) or RM23,000 (off working hours)
2)Permanent disablement: Up to RM23,000 (working hours) or RM23,000 (off working hours)
